Terms of Service – eny.space

Effective 1 July 2026

1. Who these terms are with

These Terms govern your use of eny.space, a managed hosting service operated by Krekeny GmbH, Karlstr. 54, 63065 Offenbach am Main, Germany (HRB 53756, Amtsgericht Offenbach am Main). Contact: hello+eny-space@krekeny.com.

By creating an account or using the service, you agree to these Terms. If you don't agree, don't use the service.

2. What eny.space is

eny.space provides managed hosting for a Personal Data Server (PDS) on the AT Protocol, plus a web interface for account operations (creating, inviting, resetting, and — where available — migrating accounts). We run and maintain the infrastructure; you run your PDS on it.

The infrastructure is operated by our hosting partner (Froxlor) in Frankfurt, Germany.

3. Your account

You're responsible for keeping your credentials secure and for activity under your account. You must provide accurate information and be legally able to enter this agreement. You must be at least 18 years old (or the age of majority where you live) to use the service.

4. Your data and your users

Everything on your PDS — your repository, records, blobs, and any accounts your end-users create — belongs to you. We host and serve it; we don't own it and we don't curate or moderate your end-users. You are responsible for your PDS's content and for your own users under applicable law, including acting on lawful complaints about them.

Your identity and data are portable by design: you can migrate your DID and repository in or out at any time using standard AT Protocol tooling. We won't lock your data in.

5. Subscriptions, billing, and grace periods

Paid plans are billed through Stripe, monthly by default. Your subscription starts when payment is made and runs for one month; if it isn't renewed, it ends one month after the last successful payment. Billing, renewals, and retries follow Stripe's standard schedule. Current prices are shown on eny.space and during signup, in euro and including any applicable German VAT.

If your subscription ends, we keep your PDS available before deleting anything:

  • Cancellation: your PDS stays active for 14 days after your paid period ends.
  • Failed payment: your PDS stays active for 30 days, since payment failures are often unintentional.
  • After the grace period the PDS shuts down; we retain your data for a further 30 days, during which you can reactivate.
  • After that window, your data is permanently deleted (see the Privacy Policy for details).

Consumer right of withdrawal (Widerrufsrecht): If you are a consumer, you have the right to withdraw from this contract within 14 days without giving reasons. The period begins when the contract is concluded. To withdraw, send us a clear statement (e.g. by email to hello+eny-space@krekeny.com) of your decision. Because eny.space is a service that starts immediately, you may ask us to begin during the withdrawal period; if you expressly consent and acknowledge that you lose your right of withdrawal once the service has been fully performed, the right ends accordingly. If you withdraw after performance has begun at your request, you owe a proportionate amount for what was provided up to that point.

(Our B2B offering is a separate product arranged individually by contacting us, and is not subject to this consumer right.)

Refunds: outside the statutory right of withdrawal above, payments already made for a running subscription period are non-refundable.

6. Acceptable use

You may not use eny.space, or allow your PDS to be used, to:

  • host or distribute illegal content, including CSAM, or content that infringes others' rights;
  • break the law or the AT Protocol network's basic operating norms;
  • attack, overload, or probe our infrastructure, or attempt to access other customers' data;
  • resell the service, or use it in ways that endanger the platform or other users. Reselling eny.space hosting to third parties is not permitted.

You, as the PDS admin, are responsible for what happens on your PDS: if something unlawful or abusive appears there, it is your job to manage or remove it. We provide the hosting and access tooling — we don't police your users. That said, we may suspend or take down a PDS or account that violates these rules or the law, or where we're legally required to, and where practical and lawful we'll give notice and a chance to fix the issue first. This reflects our obligations under the EU Digital Services Act. Report illegal content or abuse to hello+eny-space@krekeny.com, which also serves as our point of contact for such notices.

7. Availability

We aim for high availability but don't guarantee uninterrupted service. Downtime can result from maintenance, our hosting partner, the wider AT Protocol network, or events outside our control. We don't promise a specific uptime percentage.

8. Warranties and liability

The service is provided "as is." To the extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.

Because hosting, migration, and portability involve stateful operations, we are not liable for data loss, failed or interrupted migrations, or downtime, except where caused by our intent or gross negligence. Our liability for slight negligence is limited to breaches of essential contractual obligations and to foreseeable, typical damages. Liability for injury to life, body, or health, and under the German Product Liability Act, remains unaffected.

You are responsible for keeping your own backups and for verifying migrations (including activating a migrated account and confirming it's reachable).

9. Termination

You can cancel any time; the grace periods in §5 apply. We may suspend or terminate your account for breach of these Terms, non-payment, or legal reasons, with notice where practical. On termination, the data lifecycle in §5 applies — and you can migrate your PDS out beforehand.

10. Changes

We may update these Terms or the service. We'll announce material changes by email or via a notice in the eny.space dashboard with reasonable notice. Continued use after changes take effect means you accept them.

11. Governing law and jurisdiction

These Terms are governed by German law. If you are a consumer, the mandatory consumer-protection rules of your country of residence still apply and are not affected by this choice of law. For business customers, the place of jurisdiction is Offenbach am Main.

Consumer dispute resolution: we are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of the German VSBG.
